Terms of Service

1. Agreement to Terms

By accessing or using the Golf Scran platform at www.golfscran.com (the "Service"), operated by Add Jam, a company based in Glasgow, Scotland, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Service.

These Terms apply to all users of the Service, including golf club managers, staff members, and golfers placing orders.

2. Description of Service

Golf Scran provides an on-course food and drink ordering platform for golf clubs. The Service includes:

  • QR code generation and management for on-course ordering
  • A mobile-friendly ordering interface for golfers
  • A kitchen dashboard for managing incoming orders
  • Payment processing via Stripe
  • Analytics and reporting tools

3. Account Registration

To use the Service as a golf club, you must create an account. You agree to:

  • Provide accurate, complete information during registration
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activity under your account

4. Fees and Payment

Golf clubs using the Service pay a subscription fee (monthly or annual) plus a transaction fee on each order processed through the platform. Current pricing is available on our pricing page.

  • Subscription fees are billed in advance on a monthly or annual basis
  • Transaction fees are deducted from order payments before settlement
  • All prices are listed in GBP and are exclusive of VAT
  • We reserve the right to change pricing with 30 days' notice

5. Payment Processing

All payment processing is handled by Stripe, Inc. By using the Service, you agree to Stripe's Connected Account Agreement and Privacy Policy. Golf clubs must complete Stripe's onboarding process to receive payouts.

6. Golf Club Responsibilities

As a golf club using the Service, you are responsible for:

  • The accuracy and legality of your menu items, descriptions, and pricing
  • Fulfilling orders placed through the Service in a timely manner
  • Complying with all applicable food hygiene and safety regulations
  • Maintaining appropriate food business registrations and licences
  • Handling any allergen information and dietary requirements
  • Managing your own tax obligations, including VAT

7. Golfer Orders

When a golfer places an order through the Service, the contract of sale is between the golfer and the golf club. Golf Scran acts as a technology provider and is not a party to the sale. Refunds and complaints about order fulfilment should be directed to the golf club.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to the Service or its systems
  • Interfere with or disrupt the Service
  • Upload malicious code or content
  • Resell or redistribute the Service without our permission

9. Intellectual Property

The Service, including its design, features, and content, is owned by Golf Scran and protected by intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property rights.

You retain ownership of the content you upload to the Service (menu items, images, etc.) and grant us a licence to use this content to provide the Service.

10. Limitation of Liability

To the fullest extent permitted by law, Golf Scran shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Cancellation and Termination

  • You may cancel your subscription at any time from your account settings
  • Monthly subscriptions end at the end of the current billing period
  • Annual subscriptions are non-refundable but will not auto-renew
  • We may terminate accounts that violate these Terms with notice
  • Upon termination, your access to the Service will cease and your data will be retained for a reasonable period before deletion

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Scotland and the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
